GENERAL TERMS AND CONDITIONS OF SALE – PARTY PROMISE
These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sales concluded between Party Promise (hereinafter the “Seller”) and any person making a purchase via the website www.party-promise.com (hereinafter the “Customer”).
The Customer declares that they have the legal capacity to enter into a contract or have parental authorization if they are a minor.

ARTICLE 1 – Scope and acceptance
These GTC apply to any order placed on the Website.
Order validation implies full and unconditional acceptance of these GTC by the Customer.
The Seller reserves the right to modify the GTC at any time. The applicable GTC are those in force on the date the order is placed.
ARTICLE 2 – Products and made-to-order production
The products offered for sale on the Website are made to order, after validation of the order and payment.
Product descriptions, characteristics, and visuals are presented with the greatest care. However:
- photographs are non-contractual;
- minor variations in color, appearance, or design placement may occur depending on screens, lighting, and the printing process;
- such variations do not constitute a defect and cannot give rise to a claim.
ARTICLE 3 – Prices
Prices are indicated in euros, excluding shipping costs.
Depending on the Customer’s location, prices may be displayed in another currency for indicative purposes via an automatic conversion system.
Shipping costs and any optional services are displayed before final order validation.
The Seller reserves the right to modify prices at any time, without affecting orders already confirmed and paid.
ARTICLE 4 – Currency and conversion
Prices displayed in a currency other than euros are provided for indicative purposes only.
The final amount charged is the one indicated at the time of order validation, in the currency displayed during payment and accepted by the Customer.
The Seller cannot be held responsible for exchange rate differences applied by banks or payment service providers.
ARTICLE 5 – Taxes and customs duties
Depending on the delivery country, the order may be subject to local taxes, VAT, or customs duties payable upon arrival of the package.
These fees are the sole responsibility of the Customer.
The Seller is not required to verify or inform the Customer of applicable taxes or duties in their country.
ARTICLE 6 – Orders
Orders are placed directly on the Website.
An order is considered confirmed after:
- payment validation;
- sending of a confirmation email.
The Seller reserves the right to refuse or cancel an order in the event of:
- a prior dispute with the Customer;
- suspected fraud;
- abnormal or unusual order volume.
ARTICLE 7 – Payment
Payment is made via the methods offered on the Website (credit card and/or other available solutions).
Payment constitutes full and final settlement of the order.
Payments do not constitute deposits.
ARTICLE 8 – Production and availability
Average production times are 2 to 5 business days.
These times may be extended during periods of high demand (EVJF, summer season, holidays, promotions).
An order containing multiple items may be shipped in several packages, with no additional charges other than those indicated at checkout.
ARTICLE 9 – Delivery
Shipping and delivery conditions are detailed in the Shipping and Delivery Policy, which forms an integral part of these GTC.
Delivery times are provided for indicative purposes only and do not constitute a contractual guarantee.
The Customer is responsible for the accuracy of the information provided (address, email, phone number).
In the event of an error resulting in non-delivery or return of the package, reshipping costs shall be borne by the Customer.
A package marked as “delivered” by the carrier is deemed received.
Claims for lost packages must be submitted within 30 days following the estimated delivery date.
ARTICLE 10 – Right of withdrawal (EU)
In accordance with Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to products made according to the Customer’s specifications or clearly personalized.
In accordance with Article 16(e), the right of withdrawal does not apply to sealed goods that have been opened for hygiene or health protection reasons.
ARTICLE 11 – Returns, refunds, and replacements
Return and refund conditions are detailed in the Return and Refund Policy, which forms an integral part of these GTC.
No refund will be issued for:
- change of mind;
- incorrect size or color chosen by the Customer;
- order placed by mistake.
A replacement or refund may be offered only in the case of a defective product, a product damaged upon receipt, or a proven printing error, subject to:
- a request made within 30 days of receipt;
- supporting photos;
- contacting contact@party-promise.com.
ARTICLE 12 – Legal warranties
The Customer benefits from the applicable legal warranties regarding conformity and hidden defects, in accordance with the legislation in force in their country of residence.
ARTICLE 13 – Liability
The Seller cannot be held liable in the event of:
- force majeure;
- delays attributable to carriers or customs authorities;
- improper use or inappropriate maintenance of the products;
- errors attributable to the Customer in the information provided.
The Seller’s liability shall not be engaged for indirect damages (loss of revenue, loss of opportunity, etc.), within the limits permitted by law.
ARTICLE 14 – Customer reviews and published content
The Customer may publish reviews.
The Seller reserves the right to remove or moderate any illegal, defamatory, offensive content or content infringing the rights of third parties.
By publishing a review, the Customer grants the Seller a non-exclusive, free right to use such content for communication and marketing purposes, without financial compensation.
ARTICLE 15 – Intellectual property
All elements of the Website (texts, images, visuals, logos, designs, trademarks) are protected by intellectual property laws.
Any reproduction or use without prior authorization is prohibited.
ARTICLE 16 – Personal data
The collection and processing of personal data are described in the Privacy Policy, which forms an integral part of these GTC.
ARTICLE 17 – Language and translation
The Website may be accessible in multiple languages through an automatic translation system.
These translations are provided for informational purposes only.
In the event of any discrepancy, interpretation error, or dispute, the French version of these GTC shall prevail and be binding.
ARTICLE 18 – Governing law and disputes
These GTC are governed by the law applicable in the country where the Seller is established, in compliance with mandatory consumer protection provisions of the Customer’s country of residence.
In the event of a dispute, the Customer is invited to contact customer service to seek an amicable solution before initiating any legal action.
